Alexis Boulva writes "Tonight, Ole André Vadla Ravnås of the Farsight project (LGPL), which 'is an audio/video conferencing framework specifically designed for Instant Messengers' for the GNU Linux operating system, finished coding a release candidate of libmimic, 'an open source video encoding/decoding library for Mimic V2.x-encoded content (fourCC: ML20), which is the encoding used by MSN Messenger for webcam conversations.' Ole, on the libmimic site, remarks that 'It should be noted that reverse-engineering for interoperability is 100% legal here in Norway (and in most European countries).' Looks like the Free/Open Source Software movement is very close to closing up one of the most noticeable software gaps remaining from its glorious efforts."

Open source as legal time bomb

Hwyman writes "TechWorld is reporting on the latest attack on open-source software by the Microsoft-backed Alexis de Toqueville Institution (ADTI). Many here will remember ADTI's previous assertion that Linux Torvald was NOT the true father of the Linux kernel. Taking the stance that OSS is in conflict with IP law, ADTI president Kenneth Brown states, 'After a brief glance at much open source software development, it becomes readily apparent that a number of open source practices directly conflict with best practices associated with protecting intellectual property.' With references like 'open sores software,' it's easy to believe that ADTI might be somewhat biased."

x1048576 writes "The Alexis de Tocqueville Institution is only one of a dozen different think tanks that have attacked Open Source. Why are all these think tanks so down on Open Source? Well, the Small Business Survival Committee is concerned that using open source will expose small business to the risk of lawsuits. Citizens Against Government Waste is concerned that the government might waste money on Open Source. Defenders of Property Rights is concerned that Open Source might be a threat to intellectual property rights. However, I was able to detect a common theme to all their criticism. They all seem to be funded by Microsoft."

Ken brown responds to his critics

An anonymous reader writes "Yes, I know it's getting boring by now, but the truth must be told... the latest Unix celebrity to come forward and criticise Ken Brown/ADTI is Unix pioneer Dennis Ritchie. The gist is that Brown is claiming an 'extensive interview' with Ritchie but this was actually limited to a single email exchange and a follow-up call from one of Brown's lackeys checking one or two facts." Reader markrages writes "Ken Brown (of the Alexis de Tocqueville Institution) replies to his critics. Dr. Tanenbaum is an 'animated, but tense individual about the topic of rights and attribution'. The GNU/Linux naming issue also makes an appearance."

akahige writes "Fresh from the debunking of the 'Linus couldn't possibly have written an OS without ripping someone off' book published by the Alexis de Tocqueville Institution, Tanenbaum has published an email he got from the consultant hired to do the code comparison between MINIX and Linux. Among other juicy comments, 'pay no attention to this man.' (There was no stolen code, either.) In related matters, ESR was apparently sent a pre-release excerpt of the book which he completely eviscerates with his usual zeal. Another story on NewsForge." An anonymous reader writes "The Alexis de Tocqueville Institute, which published the results of their very thorough investigation today, turned out to be right. Linus really isn't the father of the Linux operating system. After having been found out, Linus had no choice but to admit -- this is what he has to say: 'Ok, I admit it. I was just a front-man for the real fathers of Linux, the Tooth Fairy and Santa Claus.'"

MrIrwin writes "According to this article on Yahoo, Linus is not the real father of Linux and Open source software is really just code nicked from other sources. " Groklaw has done a dissection of the press release. It's a press release by the Alexis de Toqueville Institution, who gets funding from MSFT, as well as believes that US IT troubles are because of free software. Oh, and terrorism works better because of open source, and the "Star Wars" program was a good idea.

In an article entitled Patents and the Penguin, the non-partisan Alexis de Tocqueville Institute observes, "[i]t is not uncommon today for patent fights to erupt even between parties that have engaged in rigorous diligence. By contrast, open source developers and distributors do not engage in patent searches, thus, there is a real possibility we will see a major patent fight involving open source, sooner than later. The article also ominously warns: "IBM will be competing with large Linux-based developers and distributors themselves. As the deployment of Linux increases, it can be expected that IBM will be going head-to-head with its "friends" in the Linux community. It is unquestionable that the biggest irony of all will be when Big Blue resorts to using its war chest of patents against a "friend" in the Linux community." Even Homer Simpson can see this coming.

The hacking convention is in its' 10th year and this is said to be the largest yet. This year there are dozens of speeches happening ranging from wireless, .Net security all the way to Mac OS X AppleScript security issues and hacks. Gathering in Las Vegas brings all the hackers together. This year the official events of Defcon include DC Shoot, Capture the Flag,Hacker Jeopardy, Scavenger Hunt, and this year's first WarDriving Contest. When Live Streams are activated the information will be posted on defcon.org and on the Defcon Forums... PS - E-Mail the Alexis Park letting them know their site isn't cross-browser compatible. Not everyone uses IE and NS ;)"

Tragedy, media and marketing

If only H.L. Mencken or A.J. Liebling were still around to weigh in on the kidnapping stories suffusing our media lately. Alas, they're not. They wouldn't even be able to find work these days. And too bad. If healthy media criticism still existed, someone might have pointed out the insane hype that shrouded tragedies like the death of Princess Di and TWA Flight 800. Pandering media hype isn't new to people who've been on the Net or the Web. Just consider the hacking and porno scares and insane coverage of offspring companies like Microsoft and Amazon. Why does a case like the kidnapping of Elizabeth Smart get so much attention when others just as horrific get none at all? The answer is as obvious as it is depressing.
